1. GENERAL INFORMATION
This Legal Notice regulates the conditions of access and use of the website available through the domain name www.celebracionpicasso.es and any of its subdomains (hereinafter, the "Web Page"). In order to use the Website it is necessary to read this Legal Notice which AC/E makes available to the user through the Website and which is complemented by the Privacy Policy and the Cookies Policy.
In compliance with the provisions of Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we hereby inform you that the Web Page is owned by SOCIEDAD MERCANTIL ESTATAL DE ACCIÓN CULTURAL, S.A. (hereinafter, "AC/E"), with registered office at calle José Abascal 4, 4º B, 28003 Madrid and holder of the e-mail address info@accioncultural.es. AC/E is duly registered in the Companies Register of Madrid, in volume 11541, folio 1, section 8, page number M-181214, entry 1, and has tax identification number A-81553521.
2. USE OF THE WEBSITE
Users undertake to use the Website in accordance with the law, morality, generally accepted good customs and public order. Users undertake to refrain from using the Web Page for purposes or effects that are illicit, contrary to the provisions of this Legal Notice, harmful to the rights and interests of AC/E or third parties or that may in any way damage or deteriorate the image or reputation of AC/E or prevent the normal use or enjoyment of the services offered by AC/E on the Web Page.
AC/E reserves the right to make any modifications it deems appropriate to the Web Page without prior notice, and may change, delete or add both the contents and services provided through the Web Page and the way in which they are presented or located.
3. INTELLECTUAL AND INDUSTRIAL PROPERTY
All the information contained on the Web Site, including its graphic design and source code, is protected by copyright and other rights set forth in Royal Legislative Decree 1/1996, of 12 April, approving the Revised Text of the Intellectual Property Law; property rights over trademarks and other rights set forth in Law 17/2001, of 7 December, on Trademarks and other regulations governing Intellectual and Industrial Property.
These rights belong exclusively to AC/E or its licensors. Therefore, any act of reproduction, distribution, transformation or public communication, as well as any type of transfer, of all or part of the contents of the Website, and in general any act of exploitation of all or part of the contents (including, without exclusion, its design, structure and distribution, texts and contents, logos, buttons, images, drawings, source code) as well as the databases and software necessary for viewing or operating the Website, is expressly prohibited. AC/E is also the owner or licensee of the trademarks, trade names, names, logos and other distinctive signs that appear on the Website.
Users undertake to respect these rights. Users may view the elements of the Web Page and even print them, copy them and store them provided that this is solely and exclusively for their personal and private use, and their transformation, distribution, public communication, making available or any other form of exploitation, as well as their modification, alteration or decompilation, is therefore strictly prohibited. In this regard, users may not under any circumstances exploit or make commercial use, directly or indirectly, in whole or in part, of any of the contents that make up the Web Page without the prior written authorisation of AC/E.
4. LINKS TO THIRD PARTY WEBSITES
The links contained in the Web Page, referring to contents whose ownership or responsibility corresponds to third parties other than AC/E, are not the responsibility of AC/E. Therefore, AC/E shall not be responsible, under any circumstances, for the legality of the contents of said page/s, and the third party shall be solely responsible for all that concerns the content of said link, especially respect for the law, morals, good customs and public order. The existence of links does not imply any kind of relationship between AC/E and the owner of the web page on which the link is established.
5. LIABILITY
AC/E disclaims all liability for:
- The operation of the Web Page, including causes of force majeure, or any others beyond AC/E's control, which is not fully operational, or there are delays or interruptions in the provision of its content.
- The damages, losses and/or lost profits that may be caused directly or indirectly by the information transmitted or communicated on the Web Page.
- The contents of the Web Page, as AC/E cannot guarantee, expressly or tacitly, implicitly or explicitly, the accuracy, truthfulness or completeness of the information offered or referenced therein.
- The existence of viruses or other elements in the contents that may cause alterations in the computer system (software and hardware) or in the electronic documents and files stored in the users' computer system.
Users shall be liable for damages of any nature due to illicit or fraudulent acts as well as any damages that AC/E or its users may suffer as a direct or indirect consequence of non-compliance with this Legal Notice, and AC/E reserves the right to take any actions it may be entitled to before the relevant judicial or police authorities.
6. JURISDICTION AND APPLICABLE LAW
The operation and use of the Website and this Legal Notice are governed by Spanish law. To the extent permitted by law, the parties, expressly waiving any other jurisdiction to which they may be entitled, agree to submit to the jurisdiction of the Courts and Tribunals of Madrid (Spain).
